Terms of Service

1. Acceptance of Terms

By accessing or using the BestAPI service ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

BestAPI provides an API gateway that allows users to access third-party AI models including DeepSeek, Qwen, and Kimi. We act as an intermediary and do not host the underlying AI models ourselves.

3. User Responsibilities

• You must not use the Service for any illegal purposes
• You must not attempt to bypass rate limits or abuse the API
• You are responsible for maintaining the confidentiality of your API keys
• You must not resell or redistribute the Service without our express permission

4. Billing and Payments

All fees are billed in USD. Payment is processed through Creem. Credits are non-refundable unless otherwise stated. We reserve the right to modify pricing with 30 days notice.

5. Service Level

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The Service is provided "as is" without warranties of any kind. We are not liable for any damages arising from the use or inability to use the Service.

6. Data Handling

We do not store or log the content of your API requests. Usage metrics are collected for billing purposes only. See our Privacy Policy for details.

7. Limitation of Liability

In no event shall BestAPI be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

8. Termination

We reserve the right to terminate access for violations of these terms. You may terminate at any time by discontinuing use. Prepaid credits will be forfeited upon termination.

9. Governing Law

These terms shall be governed by the laws of the Hong Kong Special Administrative Region.
